Why This Program Exists
Not Every Co-Parenting Dispute Belongs in a Courtroom
Family Court proceedings are often slow, expensive, and adversarial. For many parents, the legal process itself increases conflict and makes it harder — not easier — to build a workable co-parenting relationship after the case ends. Yet without any structure, informal attempts to resolve disputes on their own frequently break down before real progress is made.
The Co-Parenting Resolution Program offered through THE NDLC LAW FIRM, PLLC gives parents in the Bronx and across New York City a guided alternative. It is not casual negotiation between individuals. It is a structured, attorney-guided process with clear rules, defined sessions, and a written outcome — giving both parents the best realistic chance to reach workable, durable agreements without the delays and expense of contested litigation.
Where a full resolution is reached, the written agreement can be reduced to a parenting plan or stipulation and, where appropriate, submitted to court for entry as an enforceable order.
The Process
How the Co-Parenting Resolution Program Works
Step 01
Consultation and Screening
Each parent completes an initial consultation with the firm. We assess whether the program is appropriate, identify the core issues in dispute, and explain the process, costs, and expectations before any commitment is made.
Step 02
Participation Agreement
Both parents sign a written participation agreement that establishes the ground rules: shared costs, minimum commitment period, confidentiality expectations, and the process for terminating participation if the program does not result in full resolution.
Step 03
Identification of Issues
The parents, with guidance from the firm, identify and prioritize the specific issues to be resolved — parenting schedules, decision-making, holidays, expenses, communication, and any other outstanding disputes.
Step 04
Structured Resolution Sessions
The parties participate in structured sessions designed to move through each issue methodically. Sessions are conducted professionally, with clear time limits and focused agendas so that progress is made during each meeting.
Step 05
Drafting the Agreement
When agreement is reached on all or part of the issues, the firm drafts a written parenting plan or stipulation reflecting the terms. Each parent has the opportunity to have the agreement reviewed by independent legal counsel before signing.
Step 06
Court Filing, If Appropriate
Where appropriate, the written agreement can be submitted to the relevant New York court for approval and entry as an enforceable court order. The firm can advise on whether court filing is appropriate in your specific situation.
Program Terms and Structure
Voluntary. Structured. With a Clear Path Forward.
Voluntary Participation
Both parents must agree in writing to participate before the program begins. Neither parent can be compelled to join. The process is voluntary — but it is not casual. Once enrolled, participants are expected to engage in good faith and to honor the terms of the participation agreement.
Shared-Cost Model
Program costs are typically shared equally between the parents unless otherwise agreed in writing. The shared-cost structure reflects the collaborative nature of the process and ensures that both parties have a meaningful financial stake in reaching resolution. Specific fee arrangements are confirmed at the outset.
Minimum Commitment Period
Both parents are expected to commit to a minimum number of sessions or a minimum participation period as defined in the participation agreement. This minimum commitment gives the process a genuine opportunity to work. Earlier termination is available where there is an emergency, a safety concern, or another basis recognized in the agreement.
Termination and Transition to Court
If the program does not result in a full resolution, either parent may terminate participation in accordance with the participation agreement, and legal proceedings may follow. Emergency court relief may be sought at any time where legally necessary, regardless of program status.
From Agreement to Enforceable Order
Turning a Final Agreement Into a Court-Ready Parenting Plan
If the parents reach a final written agreement through the Co-Parenting Resolution Program, that agreement can be reduced to a formal parenting plan or stipulation prepared by the firm. Before signing, each parent is encouraged — and has the right — to have the agreement independently reviewed by their own legal counsel.
Where appropriate under applicable New York law and court rules, a signed parenting plan or stipulation can be submitted to Family Court or Supreme Court for judicial approval and entry as an enforceable order. An enforceable court order provides a clear legal framework and remedies if one parent fails to comply with the agreed terms.
Whether court filing is appropriate in your specific situation depends on the facts, the nature of the agreement, and the applicable legal requirements. The firm will advise you on the most appropriate path after agreement is reached.
